The purpose of these General Conditions of Sale is to govern relations between EURL ROCK ANGE'HELL, whose head office is located 21B rue des Châtaigniers - 44690 CHATEAU-THEBAUD - FRANCE, and any customer of the site www.rockangehell. com.

Placing an order directly entails acceptance of these general conditions of sale by the customer.

3. CONDITIONS FOR PLACING AN ORDER

You declare that you are at least 18 years old and have the legal capacity or hold parental authorization allowing you to place an order on the site www.rockangehell.com.

In the event that the order is placed by a minor, it must be made in the name of the parents or legal guardian with their agreement. Additional supporting documents may be requested.

4. PRODUCTS

a) Product characteristics

The products are described and presented with the greatest possible accuracy. However, if you notice that one of the items presented does not meet your expectations, do not hesitate to contact us at 09.80.80.13.12 (no surcharge) or via the Contact page.

b) Availability of replacement products and items

If out of stock, the words “unavailable” will appear in front of the size concerned. In this case, you can request to receive an alert for this product. An e-mail will then be sent to you as soon as the product is available again.

If a size for an item is not displayed, it means the product is no longer available for sale.

Exceptionally, it may happen that a product is no longer available, temporarily, after validation of the order. In this case, ROCK ANGE'HELL will inform you as soon as possible by email (maximum within 72 hours) and suggest that you either cancel your order or wait until delivery by our supplier, specifying the deadline. You will then only be debited for the amount of the items shipped.

c) Protected trademarks

The brands and groups mentioned on the site www.rockangehell.com are registered and protected by their respective owners.

5. PRICE

a) The price of the products

The prices of items appearing on the site are expressed in Euros (€) and are subject to applicable taxes. All prices indicated are inclusive of all taxes (TTC) and do not include shipping costs.

ROCK ANGE’HELL reserves the right to make changes to its prices at any time and without notice. However, the applicable prices are those in force on the day the order is registered.

You will have to pay, in addition to the price of the products, a flat-rate contribution to the costs of sending and processing your order, the amount of which will be specified on the order form before validation of the latter.

Any order placed on ROCK ANGE’HELL and shipped outside mainland France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination.

These possible customs duties and taxes, linked to the delivery of an item, are your responsibility and are your responsibility. ROCK ANGE’HELL is not required to check and inform you of applicable customs duties and taxes. To find out about them, it is advisable to contact the competent authorities in your department, territory or country.

b) Promotions and discount codes

Promotion: The price to pay is that indicated after deduction.

Discount codes: They are available from time to time through the newsletter or the fan page. Unless otherwise stated, promotional codes can only be used once per order and until the offer validity date. They cannot be combined and cannot be deducted from shipping costs. To benefit from the offer, the discount codes must be entered when placing your order.

c) Kdo checks

The procedure to follow to use your kdo check is simple:

1. Make your choice of items and put them in your basket.

2. Log in to your customer account.

3. Enter the Kdo check code in the box provided for this purpose.

4. Validate your order.

Good to know :

- Your code can be used once or several times, until the amount of your kdo check is completely used up.

- Your kdo check is valid for 1 year on the site www.rockangehell.com

- When the value of your order is greater than the amount of your Kdo check, the difference must be paid by payment card, check or transfer.

- If you wish to use several Kdo checks, enter the code of the first check when completing your payment method, then click ok. You can repeat this operation as many times as you want.

- A Kdo check cannot be exchanged for cash

- The site's general conditions of sale apply to Kdo checks.

In the event of cancellation of the order or return of item(s), the refund will be made on the kdo check used for payment. If you had to pay for part of the item by credit card or transfer, this part will be refunded to the payment method used.

d) Assets

If you have a credit, you can claim its use by specifying your credit number in the “promotion code” box.

6. SECURE PAYMENT MEANS

ROCK ANGE’HELL reserves the right to refuse one method of payment and to offer another.

You can choose to pay for your order:

a) by bank card:

ROCK ANGE’HELL accepts French bank cards (bearing the CB symbol) and international bank cards (bearing the VISA or MASTERCARD symbol).

b) by Bank Transfer

Transfers must be made in EUROS (€) to the order of ROCK ANGE’HELL and stipulated at no cost to the beneficiary. Please provide us with your order number as a reference.

Only the net amount deposited into the ROCK ANGE’HELL account will be taken into account.

c) by Kdo Check

Refer to article 5.c above.

7. DELIVERY

a) Mode of transportation

The products will be delivered to you at the address you indicate on the order form (only in mainland France, Corsica, Belgium, Switzerland and Luxembourg).

For this, you will have the choice between different modes of transport which can be viewed on the “Delivery” page.

The requested participation is detailed and indicated before validation of the order or on the “Delivery” page.

In the event that the address indicated is not correct or incomplete, ROCK ANGE’HELL will be entitled to request payment of new delivery costs.

b) Delivery times

Delivery times are:

• 2 working days after preparation of the order, i.e. 3 to 4 days to receive your package including the time it takes to prepare your package for mainland France and Corsica (except in cases of force majeure)

• 4 working days after preparation of the order, i.e. 5 days to receive your package including the time it takes to prepare your package for Belgium and Luxembourg (except in cases of force majeure)

• 6 working days after preparation of the order, i.e. 7 days to receive your package including the time it takes to prepare your package for Switzerland (except in cases of force majeure)

Your order will be prepared within 24 hours of your order, except in the event of non-payment

Please note, however, that any order paid by transfer will only be processed upon receipt of payment. Shipping times must be recalculated from the date payment is received.

In the event of non-compliance with deadlines, you can contact our team, preferably by telephone, at 09.80.80.13.12 (price of a local call) or by email via the Contact section in order to open an investigation.

You are informed in real time of the progress of the processing of your order from your customer account. To view the delivery of your package directly, you have a tracking code for your package that can be used on the carrier's website.

In order to guarantee you optimal service, we thank you for always providing us with an address to which your order can be delivered during business hours. You must provide ROCK ANGE’HELL with a complete and exact delivery address to the nearest character according to the carrier’s conditions (building, floor, location, etc.).

c) Late delivery

In the event of late delivery within 10 working days following the shipping date indicated in the email, please contact our Customer Service immediately (see Art.2). However, we invite you to contact your post or collection office in advance to find out whether or not they have received your package (flashing errors may prevent the package from being correctly tracked on the Post Office website).

A carrier investigation will be opened at the request of ROCK ANGE’HELL in order to locate your package. If during this period, the product is found, it will be redirected to your home as quickly as possible (except for deliveries to a collection point). Beyond that, the package will be considered lost.

At the end of the investigation, we will send you a replacement product (return at our expense). If the product(s) ordered are no longer available, you will be able to obtain a refund for the products concerned by the carrier's confirmed declaration of loss.

In the event of late delivery, and at the latest within 30 days after the order, you have the option of resolving the contract, by registered letter with acknowledgment of receipt, or in writing on another durable medium, if, after having ordered, according to the same terms, ROCK ANGE'HELL to make delivery within a reasonable additional period, and that the latter has not complied within this period.

d) Refusal of packages or failure to claim packages

If you decide to refuse the package, you must notify us immediately, either by email via the "Contact" section, or by telephone at 09.80.80.13.12.

Upon receipt of the package at our premises, the reimbursement of the items will be made without delay or at the latest within 14 days following receipt of the package. If a package is refused and does not fall within the legal right of withdrawal, shipping costs will not be refunded. In addition, depending on the carrier chosen, you may be charged reshipping and non-complaint fees (see below).

In the event of a return to sender following a non-claimed package or a refusal of a package, you must contact us within 10 days of the package being made available to inform us of the cancellation of your order. After this period, reimbursement will be made in the form of a credit valid for 6 months on the site (excluding delivery costs).

Delivery to collection point:

You are informed that if you choose delivery to a collection point and the latter is closed or unavailable for various reasons, your package will be delivered to another relay point (merchant or post office) close to the one initially chosen and this without the prior agreement of the sender or recipient. You will not be able to choose the replacement collection point, it will be chosen by the Post Office.

If you do not collect your package from a collection point (whether the latter is the one you have chosen or not), it will be returned to us after 10 days, a fee of €3 will be charged. following the return of the unclaimed package, these costs will be deducted from the reimbursement of the item. Additionally, initial shipping costs will not be refunded.

If you wish to return the package to a collection point, a fee of €4.99 will have to be paid for returning the package, as well as a fee of €3 following the failure to claim the package.

In the event of non-complaint of a package sent as part of an exchange, for delivery to a collection point, if you are not going to collect the package within the allotted time and the package has been returned to us, return costs will be invoiced for an amount of €4.99 + €3 non-complaint fees following the return to sender, even for orders with a value greater than €199 (free shipping costs are only valid for the initial order and for the 1st exchange).

Case of error in the address for Colissimo home delivery:

If an address error results in a return of the package, return costs will be requested:

- €9.99 corresponding to the new shipment for France and Corsica

-14.00€ for Belgium and Luxembourg

- €16.00 for Switzerland

Also, in the event of an address error on your part or an incomplete address, neither the responsibility of ROCK ANGE’HELL nor that of the carrier can be engaged.

If you wish to reimburse the package following the return to sender caused by the address error, the shipping costs initially paid will not be refunded.

Important: re-routing times following a return sender can vary from 3 to 60 days. No refund or credit will be made before receipt of the package at our premises.

8. RECEIPT OF THE ORDER

Please note, if you entrust the receipt of the product to a third party (concierge in your building, receptionist at the workplace, etc.) they will receive the package in your name and on your behalf.

He is responsible in this capacity, so you must ask him to be vigilant in following the usual precautions and remind him to take the same care with the thing received as if he were the personal recipient.

We ask you to be particularly vigilant when receiving your order regarding its verification and the detection of a possible anomaly.

DAMAGED OR OPEN PACKAGE:

For delivery to a collection point or against signature: You must check the general condition of the package. If it has been opened, is damaged or has holes, you are asked to check the contents of the package in front of the person who gives it to you.

If the latter is incomplete or contains items damaged during transport, you must refuse it, specifying the reason for refusal (example: damaged or missing items, specifying which ones...), then contact us immediately by telephone.

ROCK ANGE'HELL may exempt itself from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer or to the unforeseeable and insurmountable act of a third party to the contract, or in a case of force majeure" according to article L.216-4: "all risk of loss or damage to the goods is transferred to the consumer at the moment when the latter or a third party is designated by him, and other than the carrier proposed by the professional, takes physical possession of these goods."

In the event that your package is returned to us for reasons of "unclaimed", "refused" or "NPAI", ROCK ANGE'HELL undertakes to contact you and keep your package for a period of thirty (30) days, after which without hearing from you, we will issue you a credit for the amount of your order (excluding shipping costs), valid for a period of six (6) months.

Recipient error: In the event that you receive a delivery that is not intended for you, we ask you to refuse the package. If you have accepted it, you are asked to keep the package as is and to inform our customer service immediately:

• Either by telephone at 09.80.80.13.12 (price of a local call).

• Either by connecting to our site in the “Contact” section.

We remind you that in accordance with article 1376 of the Civil Code, in the event that you receive an order that is not intended for you, you are then obliged to return it. Failing this, ROCK ANGE’HELL will be entitled to invoice you for the product you received.

Any package received in duplicate or received in error must be returned to us. In this context, you must contact customer service so that a prepaid label for returning the package can be provided to you.

9. ORDER MODIFICATION, CANCELLATION AND REFUND

a) Modification of the order before sending

As long as your order is not “Shipped”, you can modify its parameters (cancellation of order, deletion of items, quantities, addresses, shipping method, etc.). To modify your order, you must contact us as soon as possible by telephone at 09.80.80.13.12 (price of a local call) or via the “Contact” page.

Since requests for modification or cancellation made by email from the “Contact” page cannot be instantaneous, ROCK ANGE’HELL does not guarantee that the desired modifications can be applied in time.

As soon as the order enters the "Shipped" phase, it can no longer be modified or canceled. You therefore have fifteen (15) days to return unwanted items to us or exchange a product (see “Right of withdrawal” Article 9-b below).

In the event of cancellation of the order before shipment: if payment by Paypal then cancellation of the order before shipment, Paypal fees will be deducted from the refund (fixed 0.35ct + 1.20% of the transaction price)

b) Right of withdrawal and refund

ROCK ANGE’HELL grants you a withdrawal period of fifteen (15) calendar days to return items that do not suit you.

This period includes the legal withdrawal period of fourteen (14) days, under Article Art. L. 121-21 of the Consumer Code, "the consumer has a period of fourteen (14) clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, in the case If applicable, return costs." The mentioned period runs from receipt of the goods. When this period expires on a weekend, public holiday or non-working day, it is extended until the next working day.

If you exercise your right of withdrawal, you can request either a refund of the amounts collected or an exchange.

This right of withdrawal is exercised without penalty. However, the return costs remain your responsibility, unless you have subscribed to the Peace of Mind Option which gives you a prepaid Colissimo return label. You must ensure that the order for which you are withdrawing is returned complete, under the conditions of articles 9-c, below. The package must be returned within 14 days following the withdrawal request. After this period no refund will be made and the product will be returned to you at your expense.

Exception: For obvious hygiene reasons (precautionary principle), internal jewelry (piercings, earrings) cannot be returned. This way you have the guarantee that the jewelry sold is in optimal hygienic conditions.

Case of returns for packages originating from Switzerland:

Following changes in European regulations for the taxation of goods, it is important to complete your customs declaration for the return of your package, specifying that it is a return of goods following purchase in a country member of the European Union. If customs clearance costs are claimed upon arrival of the package in France following an incorrect customs declaration, the costs will be deducted from the reimbursement, the return costs being entirely the responsibility of the customer living in Switzerland.

Case of returns for packages originating from France:

• In the event of a return for reimbursement of all items in the order, the total amount of the order (products and shipping costs, excluding prepaid return label) will be refunded, on the basis of the least expensive shipping costs offered on the site, i.e. €4.99 for an order under €199, no refund for orders over €199 (shipping costs being free from this amount). In the event of a partial return, only the product(s) ordered (excluding shipping costs) will be refunded.

• In the case of an order which has not been collected from a collection point or post office, or which is returned to us for incomplete address, NPAI or refusal of package, the shipping costs will not be refunded.

• In the case of an initial order exceeding €199, shipping costs at Colissimo relay points are free, and reduced at Colissimo with signature. In the event of return of one or more of the products, the order falling below the amount of €199, the shipping costs which should have been paid will be deducted from the refund made, as follows:

€X (amount of the product(s)) - €4.99 (shipping costs normally paid at a relay point) = €X to be refunded

The amount of shipping costs subtracted from the refund appears in the “processing costs” line.

• In the case of a request for reimbursement of an item received as part of an exchange procedure, only the amount of the item(s) will be refunded (the amount of the exchange shipment being due following the reimbursement request).

If the order is paid via a kdo check, the reimbursement will be made on the kdo check used for payment. If you had to pay for part of the item by credit card or transfer, this part will be refunded to the payment method used.

In the event of a refund, we undertake to reimburse you without delay and at the latest within fourteen (14) days following the date of receipt of the package.

The withdrawal period does not apply to the purchase of the Peace of Mind Option.

If you subscribe to the Peace of Mind Option:

You receive your order at home. If after fitting, it does not suit you, you have 15 days to request an exchange or refund via your customer account.

We will then send you a return confirmation email and you can, at that time, log in to your customer account to print 2 documents:

1 – the pre-filled return form to put in your package

2 – the prepaid Colissimo label to stick on your package

You can then return your package:

- Directly in your mailbox (standard format), the postman will collect it during his tour and it will be returned to us. In this case, you should register on the Colissimo “BAL return” website in order to schedule the recovery of the package.

- By dropping it off at your post office

In both cases, the proof of deposit will be signed and stamped by the Post Office, the recipient keeps it.

The Peace of Mind Option is only valid once, for all items in the order to which it is attached and cannot be refunded. Its validity period is 15 days from the return request made on the site via the customer account and is only valid for a single exchange or refund request. This means that in the event of a request to return an item received in exchange, the return will be the responsibility of the customer (the label is only valid for the first return request).

This label cannot be sold alone and is only valid for mainland France and Corsica.

c) Precautions to take when returning a package

We draw your attention to the fact that you must return the product:

• by declaring the value of the product, as indicated on the purchase invoice,

• ensuring perfect insurance coverage of return risks, in relation to the purchase invoice.

Indeed, in the event of a return at your expense and excluding additional insurance, you are informed that the carrier will only compensate you up to the legal scale.

d) Return conditions for an exchange or refund

To guarantee a faster product exchange or refund, you are asked to contact us before taking any steps, via the Product Returns section of your customer account to inform us and obtain the appropriate procedure to follow according to your request. For an exchange request, it is imperative to specify the reference and the desired size in the comment section, to obtain the guarantee that the products you want in exchange are reserved for you.

To do this, you have fifteen (15) working days upon receipt of the package, delivery date being taken as proof. If this deadline expires on a Sunday or public holiday, it is extended until the first following working day.

You are asked to return the products under conditions which ensure that they are suitable for further marketing. You must have worn/passed the goods only for a fitting, such as in a retail store for example, and return them in full, in their original condition and original packaging, intact and without damage. You may be held responsible for any loss of value of the goods due to handling beyond what is necessary to ascertain their characteristics and proper functioning.

e) Reference error in the order

If you notice a reference error in your order, you are asked to contact customer service as soon as possible, either by telephone at 09.80.80.13.12 (price of a local call), or via the section “Contact” to inform us and obtain the procedure to follow.

d) Item with a defect

In the case of a return request for an item with a defect, a pre-paid return label will be sent to you and a new item (same reference, same size) will be sent to you upon receipt of the package. If the item cannot be exchanged due to lack of available stock, you will be offered either a refund for the item or the option to keep the merchandise.

If you wish to exchange for another size or other reference, the standard return procedure will apply and the return costs will be your responsibility, unless you have subscribed to the Peace of Mind Option. If the exchange is possible and you still wish to obtain a refund, the return costs will be your responsibility.

10. LEGAL GUARANTEES

The items we offer are subject to the legal guarantee of conformity set out in articles L. 211-4 et seq. of the Consumer Code and to the guarantee against hidden defects set out in articles 1641 et seq. of the Civil Code.

Consumer Code - article L211-4

The seller is required to deliver a voucher conforming to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

Consumer Code - article L211-5

To comply with the contract, the property must:

1) be suitable for the use usually expected of similar goods and, where applicable:

• correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model,

• present the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling.

2) or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Consumer Code - article L211-12

The action resulting from the lack of conformity is prescribed two years from the delivery of the goods.

Civil Code - article 1641

The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would not would have given a lower price for them, if he had known them.

Civil Code – article 1648

Action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

11. RESERVATION OF OWNERSHIP AND RESPONSIBILITIES

The products remain the property of ROCK ANGE’HELL until full payment of the total amount of the order and physical receipt of the goods by the customer, or a third party designated by the customer.

12. INTELLECTUAL PROPERTY

All creations (graphic charter, content, image, typography, etc.) are the strict property of ROCK ANGE'HELL, they cannot under any circumstances be distributed on any media other than on the website. www.rockangehell.com. Any use of these creations must be the subject, in advance, of a request from EURL ROCK ANGE’HELL by contacting us by e-mail via the Contact section or by post.

13. DISPUTES AND APPLICABLE LAW

ROCK ANGE’HELL reserves the right to cancel any order from a customer with whom there is a prior dispute.

a) Anti-fraud policy

In order to ensure the security of transactions and to respond to the concern of the greatest number of people to prevent fraud in distance selling, ROCK ANGE’HELL carries out random checks on the placing of orders.

As part of a random check, we invite you by email to send proof of address and/or identity (the aim being to ensure the reality of the identity and domiciliation with, for example, a receipt EDF, a telephone bill, and an identity document) for the completion of the order.

In the absence of proof or if the documents sent do not make it possible to ascertain the identity of the author of the order and the reality of the domiciliation, we would be obliged to cancel the order to guarantee security. online transactions.

b) Attribution of jurisdiction

14. MEDIATION

If a dispute arises, any customer can send a written request in LRAR to the Rock Ange'Hell store, which will do everything necessary to resolve it.

This last provision only applies to countries of the European community (excluding Switzerland).

For its part, the Rock Ange'Hell store reserves the right to submit any possible dispute exclusively to the courts.
